    "factual_background": "FACTS ASSERTED BY THE COMPLAINANT AND NOT CONTESTED BY THE RESPONDENT:\r\n\r\nThe Complainant states that the disputed domain name <predica.org> is identical to his trademark PREDICA and his domain name <predica.com>.\r\n\r\nIndeed, the disputed domain name <predica.org> contains the Complainant’s registered trademark PREDICA in its entirety, without any adjunction of letters or words.\r\n\r\nThe Complainant further contends that:\r\n\r\n1) the Respondent is not affiliated with nor authorized by the Complainant in any way. The Complainant contends that the Respondent has no rights or legitimate interests in respect of the domain name. The Complainant does not carry out any activity for, nor has any business with the Respondent.\r\n\r\n2) that the website in relation with the disputed domain name <predica.org> has not been used since its registration. There is no information of demonstrable preparations to use the disputed domain name in connection with a bona fide offering of goods or services. \r\n\r\n3) that the Respondent has not responded to the cease-and-desist letter sent to him in order to justify the reason why he registered the disputed domain name\r\n\r\n4) that the disputed domain name has been registered and is being used in bad faith\r\n\r\n5) that the incorporation of a famous mark into a domain name, coupled with a non used website, may be evidence of bad faith registration and use.\r\n\r\n6) that the disputed domain name was registered in order to prevent the owner of the trademark from reflecting this name in a corresponding domain name.\r\n\r\n",
