    "factual_background": "<p><strong>FACTS ASSERTED BY THE COMPLAINANT AND NOT CONTESTED BY THE RESPONDENT:<\/strong><\/p>\n<p>The Complainant, E.ON SE, is a European electric utility company based in Essen, Germany. The E.ON Group of companies runs one of the world's largest investor-owned electric utility service providers. The Complainant invested more than 500 million US Dollars in a 440-megawatt windfarm in Texas and publicised this in August of 2019 as the largest investment of the Complainant in the United States at the time.<\/p>\n<p>The Complainant is the owner of the well-known trademark &ldquo;E.ON&rdquo; and has registered an extensive portfolio of trademarks, including:<\/p>\n<ul>\n<li>EUTM 006296529 &ldquo;e.on&rdquo; registered by the EUIPO on 27\/06\/2008 in classes 07, 36, 37 and 40;<\/li>\n<li>EUTM 002361558 &ldquo;E.ON&rdquo; registered by the EUIPO on 19\/12\/2002 in classes 35, 39, 40; and<\/li>\n<li>DE 39982704 &ldquo;e.on&rdquo; registered by the German PTO on 22\/05\/2022 in classes 04, 35, 36, 37, 38.<\/li>\n<\/ul>\n<p>The Complainant also owns numerous domain names consisting of the trademark &ldquo;EON&rdquo; including &lt;eon.com&gt; and, through its subsidiary E.ON UK Ltd, &lt;eon-energy.net&gt;.<\/p>\n<p>The disputed domain name &lt;eoneneirgy.com&gt; was registered on April 20, 2022. It does not resolve to an active website.<\/p>\n<p>The Complainant and the Respondent have never had any previous business or other relationships, nor has the Complainant ever granted the Respondent any rights to use the E.ON trademark.<\/p>\n<p>There is no evidence of any kind of establishment related to the Complainant under the address of Respondent, which leads to a trailer home in Texas with no links whatsoever to the Complainant.<\/p>\n<p>The Complainant has not found any evidence pointing to the fact that the Respondent could be commonly known by the disputed domain name or has any other legitimate interest in that name. A Google search for &ldquo;eoneneirgy&rdquo; pointed straight to the Complainant and its business activities.<\/p>\n<p>It is more than unlikely that Respondent was unaware of Complainant&rsquo;s prior rights in the trademark E.ON at the time of registering the disputed domain name, given the well-known character of the Complainant&rsquo;s name. The Respondent has been using the disputed domain name to resolve to an inactive website and has been using a privacy shield to conceal its identity.<\/p>",
