    "factual_background": "<p>The Complainant is a German family-owned pharmaceutical group of companies with roots going back to 1885, when it was founded by Albert Boehringer (1861-1939) in Ingelheim am Rhein. Ever since, BOEHRINGER has become one of the top 20 companies in the pharmaceutical industry with over 53,000 employees. In 2022, net sales of the BOEHRINGER group of companies amounted to about 24.1 billion euros.<\/p>\n<p>JARDIANCE (Empagliflozin) is a prescription medicine used along with diet and exercise to lower blood sugar in adults with type 2 diabetes, and also to reduce the risk of cardiovascular death in adults with type 2 diabetes who have known cardiovascular disease.<\/p>\n<p>The disputed domain name was registered on 23 January 2024 and is held by the Respondent.<\/p>\n<p>The domain name website (i.e. website available under internet address containing the disputed domain name) includes random, likely automatically generated, links to third party websites not in any way related to the Complainant.<\/p>\n<p>The Complainant seeks transfer of the disputed domain name to the Complainant.<\/p>",

    "no_response_filed": "<p><strong>COMPLAINANT:<\/strong><\/p>\n<p><span style=\"text-decoration: underline;\">CONFUSING SIMILARITY<\/span><\/p>\n<p>The Complainant states that:<\/p>\n<ul>\n<li>The disputed domain name is identical to Complainant's Trademarks as they both incorporate the &ldquo;JARDIANCE&rdquo; word element of the Complainant&rsquo;s trademarks in its entirety and the &ldquo;.site&rdquo; element must be disregarded.<\/li>\n<li>The Complainant refers to previous domain names decisions in this regard.<\/li>\n<li>Thus, according to the Complainant the confusing similarity between Complainant&rsquo;s trademarks and the disputed domain name is clearly established.<\/li>\n<\/ul>\n<p><span style=\"text-decoration: underline;\">NO RIGHTS OR LEGITIMATE INTERESTS<\/span><\/p>\n<p>The Complainant states that:<\/p>\n<ul>\n<li>The Respondent has not been commonly known by the disputed domain name.<\/li>\n<li>The Complainant has not authorized, permitted or licensed the Respondent to use Complainant&rsquo;s trademarks in any manner. The Respondent has no connection or affiliation with the Complainant. whatsoever. Therefore, the Respondent must have been aware of such trademarks and their reputation. This clearly indicates bad faith registration of disputed domain name by the Respondent.<\/li>\n<li>The disputed domain name website resolves to a parking page with commercial links.
