The Complainant is a Chinese video game development company which was founded in 2011. Among the various video games produced and marketed by the Complainant is an action role-playing game called “Genshin Impact”. It was released for Android, iOS, PlayStation 4, and Windows in 2020, and for PlayStation 5 in 2021. The game features an anime-style open-world environment and an action-based battle system using elemental magic and character switching. The game has received positive reviews, and the game has generated more than US$1 billion in gross revenue across all platforms by the end of 2022.<\/p>\n
The Respondent uses the disputed domain name to operate a website where visitors are offered to purchase accounts or upgrades for the game Genshin Impact (and for other trademarked and copyrighted titles of the Complainant). The Respondent’s website uses several of the Complainant’s own copyrighted images for this purpose. At least in the past, the name of the game “Genshin Impact” (in Cyrillic script) was also explicitly used on the website.<\/p>\n
The Complainant contends that the Respondent is not affiliated with or authorized by the Complainant in any way. The Complainant also contends that the Respondent has no rights or legitimate interests in respect of the disputed domain name. The Respondent does not carry out any activity for, or has any business with, the Complainant.
