FACTS ASSERTED BY THE COMPLAINANT AND NOT CONTESTED BY THE RESPONDENT:<\/p>\n
The Complainant considers that the disputed domain name is confusingly similar to its trademark BOURSO because it includes in its entirety the trademark, and the addition of the generic term “FIRST” is not sufficient to escape the finding that the disputed domain name is confusingly similar to the trademark BOURSO. The Complainant, bearing in mind that BOURSOFIRST is the name of its private banking, adds that the addition of that generic term and of the generic top-level domain \".CONTACT\", does not change the overall impression of the designation as being connected to the Complainant’s trademark BOURSO and does not prevent the likelihood of confusion between the disputed domain name and the Complainant and its trademark. <\/span> The Complainant contends that the Respondent did not make any use of the disputed domain name, and adds that the Respondent has no demonstrable plan to use the disputed domain name. The Complainant adds that the disputed domain name has been set up with MX records, which suggests that it may be actively used for email purposes. The Complainant considers that any e-mail emanating from the disputed domain name could not be used for any good faith purpose.<\/span><\/p>\n The Complainant concludes that the Respondent has registered and is using the disputed domain name in bad faith.<\/span><\/p>\n<\/div>",
