THE COMPLAINANT <\/p>\n
The Complainant contends that the requirements of the Policy have been met and that the disputed domain name should be transferred to it.<\/p>\n
In particular, the Complainant asserts that the disputed domain name reproduces PHILIPS trademark with a descriptive term “buy”. By adding a word, in this case “buy”, the confusing similarity is met.<\/p>\n
The Complainant also affirms that the Respondent has not been authorized use its marks or to apply for domain name using them and, the Respondent is not commonly known by the disputed domain name. Neither the Respondent holds a genuine trademark right.<\/p>\n
Furthermore, the Respondent´s use of the disputed domain name confirms the lack of rights or legitimate interests as it carries a high risk of implied affiliation.<\/p>\n
The Respondent is using the disputed domain name to redirect internet users to its website where the Oki Data Test is not complied since the site does not accurately and prominently disclose the Respondent´s relation with the Complainant and its trademarks.<\/p>\n
With reference to the third requirement, the Complainant alleges that based on the distinctiveness of PHILIPS mark, the Respondent was aware of Complainant's rights prior to the registration of the disputed domain name.<\/p>\n
The Complainant also asserts that the Respondent is using the disputed domain name intentionally to attempt to attract, for commercial gain, internet users to his web site by creating a likelihood of confusion with the Complainant's mark as to the source, sponsorship, affiliation or endorsement of his web site in terms as set up in paragraph 4(b)(iv) of the Policy.<\/p>\n
