The Complainant is Deutsche Börse AG, a leading market place organizers for financial services, particularly services for trading in shares and other securities worldwide. The Complainant is the parent company of Deutsche Börse Group which, inter alia, consists of Eurex Frankfurt AG (wholly-owned subsidiary) and Eurex Global Derivatives AG (wholly-owned subsidiary). Moreover, the Complainant is a transaction service provider, which affords international companies and investors access to global capital markets by means of advanced technology. Previous panelists in other UDRP procedures have recognized the EUREX trademark as a renowned trademark. The disputed domain name was registered on June 18, 2025. Currently the disputed domain name is not active. However, from the submission provided by the Complainant it appears that the disputed domain name previously resolved to a website where trading services were offered, and the Complainant’s EUREX trademark was displayed.<\/p>", "other_legal_proceedings": "

COMPLAINANT: <\/span><\/p>\n The Complainant contends that: <\/span><\/p>\n 1. The disputed domain name is confusingly similar to the Complainant's trademark. <\/span><\/p>\n The Complainant contends that the disputed domain name, which contains the EUREX trademark in its entirety, is confusingly similar to its distinctive \"EUREX” trademark.<\/p>\n 2. The Respondent does not have any rights or legitimate interest in the disputed domain name.<\/p>\n The Complainant contends that the Respondent is not commonly known by the disputed domain name and that the Respondent is not affiliated with or authorized by the Complainant in any way. The Complainant contends that the Respondent has no rights or legitimate interests in respect of the disputed domain name, and is not related to the Complainant’s business in any way. The Complainant does not carry out any activity for, nor has any business dealings with, the Respondent. The Complainant further affirms that the disputed domain name is used to impersonate the Complainant or at least to create the false impression of an affiliation with the Complainant, and that such conduct can never confer rights or legitimate interests on a Respondent.<\/span><\/p>\n 3. The disputed domain name has been registered and is being used in bad faith.<\/p>\n The Complainant contends that owing to the distinctiveness of the Complainant’s trademark, it is inconceivable that the Respondent could have registered the disputed domain name without actual knowledge of Complainant's rights in the EUREX trademark. In addition, the Complainant contends that the Respondent is deliberately trying to impersonate the Complainant in an attempt to exploit the goodwill associated with the Complainant's trademark and to deliberately mislead Internet users into engaging his services under the false belief that they were dealing with the Complainant. In addition, the Complainant documents that the Respondent, on the disputed website, is allegedly providing a trading platform for digital currencies, and that, owing to the fact that no contact details are provided and no reference to a competent financial regulation authority is given, it is apparent that this is not a trustworthy trading platform, but a fraudulent site that is deliberately using the Complainant's \"EUREX\" trademark to benefit from the Complainant's reputation as a trustworthy and reliable provider of financial services.<\/p>\n <\/p>\n RESPONDENT:<\/p>\n The Complainant has, to the satisfaction of the Panel, shown the disputed domain name is identical or confusingly similar to a trademark or service mark in which the Complainant has rights (within the meaning of paragraph 4(a)(i) of the Policy).<\/p>",
