    "factual_background": "<p><span>The Complainant, created in 1996 through a merger of two other companies, Ciba-Geigy and Sandoz, is the holding company of the Novartis Group. <\/span>In 2024, the Novartis Group achieved net sales of USD 50.3 billion, and total net income amounted to USD 11.9 billion and employed 75 883 full‑time equivalent employees as of December 31, 2024.<span>&nbsp;<\/span><\/p>\n<p><span><\/span><span>The Complainant informs that its <\/span>products are manufactured and sold in many countries worldwide, including in Vietnam, where it has an active presence through its associated company Novartis Vietnam Company Limited.&nbsp; The Complainant has also proven to have trademark rights to the term NOVARTIS in many countries, including Vietnam.<\/p>\n<p>The Complainant trademark registrations predate the registration of the disputed domain names &lt;jobnovartis.com&gt;, &lt;jobnovartisvietnam.com&gt; and &lt;novartisvietnam.com&gt; which were all registered on December 2, 2025.<\/p>\n<p><span>According to the Complainant, the domain names in dispute are similar to its NOVARTIS trademark since all of them incorporate the well-known distinctive trademark NOVARTIS in its entirety combined with generic and\/or geographical terms.<\/span><br \/><br \/><span>The Complainant has not found that the Respondent is known by the disputed domain names terms. Indeed, when searching for &ldquo;jobnovartis&rdquo;, &ldquo;job novartis&rdquo;, &ldquo;jobnovartisvietnam.com&rdquo;, &ldquo;jobnovartisvietnam&rdquo;, &ldquo;job novartis vietnam&rdquo;, &ldquo;novartisvietnam.com&rdquo;, &ldquo;novartisvietnam&rdquo; or &ldquo;novartis vietnam&rdquo;, no information is found in relation to trademarks corresponding to the aforementioned terms. The Complainant argues that the Complainant trademarks predate the registration of the domain names in dispute and that the Respondent has never been authorized by the Complainant to register the domain names.<\/span><\/p>\n<p>In the Complainant's view, the structure of the disputed domain names in and of itself reflects the Respondent&rsquo;s intention to create an association, and a subsequent likelihood of confusion, with the Complainant's \"NOVARTIS\" trademark and the Novartis group in Internet users&rsquo; mind, as by reading the disputed domain names, Internet users may believe that they are directly connected to or authorized by the Complainant.<\/p>\n<p><span>Furthermore, the Complainant notes that the disputed domain names are being passively held, meaning that they do not resolve to active websites.&nbsp; This circumstance demonstrates that there is no evidence showing that the Respondent has been using, or preparing to use, the disputed domain names in connection with a bona fide offering of goods and services or has made a legitimate noncommercial or fair use of the disputed domain names<\/span><\/p>\n<p><span>The Complainant insists that the circumstances of the case may indeed be such that it is not possible to conceive of any plausible actual or contemplated active use of the domain name by the Respondent that would not be illegitimate, such as by being a passing off, an infringement of consumer protection legislation, or an infringement of the Complainant&rsquo;s rights under trademark law.&nbsp;<\/span><\/p>\n<p>Finally, the Complainant informs that different attempts to contact the Respondent were made through cease-and-desist letters sent to the Registrant of the disputed domain names and that it has never received any response. Finally, Complainant notes that the Respondent has been using privacy shield to conceal its identity.<\/p>\n<p><span>&nbsp;<\/span><\/p>",
