    "factual_background": "<p>FACTS ASSERTED BY THE COMPLAINANT AND NOT CONTESTED BY THE RESPONDENT:<\/p>\n<p>THE COMPLAINANT<\/p>\n<p>The Complainant, which was founded in 1871, is a French industrial business trading internationally. It manufactures and offers products for power management, automation, and related solutions. The Complainant's corporate website can be found at <u>www.schneider-electric.com<\/u>.<\/p>\n<p>The Complainant is featured on the NYSE Euronext and the French CAC 40 stock market index. In 2024, the Complainant revenues amounted to 38 billion euros.<\/p>\n<p>The Complainant owns several trademarks including the terms &ldquo;SCHNEIDER ELECTRIC&rdquo;, such as:<\/p>\n<ul>\n<li>The international trademark SCHNEIDER ELECTRIC n&deg; 715395 registered on March 15, 1999;<\/li>\n<li>The international trademark SCHNEIDER S ELECTRIC n&deg; 715396 registered on March 15, 1999;<\/li>\n<li>The European trademark SCHNEIDER ELECTRIC n&deg; 1103803 registered on March 12, 1999.<\/li>\n<\/ul>\n<p>The Complainant is also the owner of many domain names which include the trademark SCHNEIDER ELECTRIC such as &lt;schneiderelectric.com&gt; registered since April 4, 1996 and &lt;schneider-electric-dms.com&gt; registered since September 25<sup>th<\/sup>, 2012.<\/p>\n<p>The disputed domain names &lt;schreider-electrlc.com&gt; and &lt;schrelder-electrlc.com&gt; &nbsp;(hereinafter, the &bdquo;Disputed Domain Names&ldquo;) were registered as follows:<\/p>\n<ul>\n<li>The Disputed Domain Name &lt;schreider-electrlc.com&gt; was created on April 25, 2026, and;<\/li>\n<li>The Disputed Domain Name &lt;schrelder-electrlc.com&gt; was created on April 28, 2026.<\/li>\n<\/ul>\n<p>In accordance with the Complainant, the websites connected to the Disputed Domain Names are inactive and the domain name &lt;schreider-electrlc.com&gt; has been used in a phishing attempt. Finally, MX servers are configured for both domains.<\/p>\n<p>According to Complainant&rsquo;s non-contested allegations, the Respondent has no rights or legitimate interest in respect of the Disputed Domain Names and the Complainant is not related in any way to the Complainant&rsquo;s business.<\/p>\n<p>For the purpose of this case, the Registrar confirmed that the language of the registration agreement is English. The facts asserted by the Complainant are not contested by the Respondent.<\/p>",

    "no_response_filed": "<p>COMPLAINANT:<\/p>\n<p>First element: Similarity<\/p>\n<p>The Complainant states that the Disputed Domain Names are confusingly similar to its trademark SCHNEIDER ELECTRIC.<\/p>\n<p>The substitution of the letter &ldquo;N&rdquo; by the letter &ldquo;R&rdquo; and the substitution of the letters &ldquo;I&rdquo; by the letters &ldquo;L&rdquo; is characteristic of a typosquatting practice intended to create confusing similarity between the Complainant&rsquo;s trademark and the Disputed Domain Names. Previous panels have found that the slight spelling variations does not prevent a domain name from being confusing similar to the Complainant&rsquo;s trademark.<\/p>\n<p>Moreover, the Complainant contends that the addition of the suffix &ldquo;.COM&rdquo;&rdquo; does not change the overall impression of the designations as being connected to the trademark SCHNEIDER ELECTRIC. It does not prevent the likelihood of confusion between the Disputed Domain Names, the Complainant and its trademark.<\/p>\n<p>Thus, the Disputed Domain Names are confusingly similar to the Complainant's trademark SCHNEIDER ELECTRIC.<\/p>\n<p>Second element: Rights or legitimate interest<\/p>\n<p>The Complainant asserts that the Respondent is not identified in the Whois database as the Disputed Domain Names. Past panels have held that a Respondent was not commonly known by a disputed domain name if the Whois information was not similar to the disputed domain name. Thus, the Respondent is not known as the disputed domain name.<\/p>\n<p>The Complainant contends that the Respondent is not affiliated with nor authorized by SCHNEIDER ELECTRIC in any way. The Complainant contends that the Respondent has no rights or legitimate interests in respect of the Disputed Domain Names. The Complainant does not carry out any activity for, nor has any business with the Respondent.<\/p>\n<p>Neither license nor authorization has been granted to the Respondent to make any use of the Complainant&rsquo;s trademark SCHNEIDER ELECTRIC, or apply for registration of the Disputed Domain Names by the Complainant.<\/p>\n<p>Moreover, the Complainant also claims that the Disputed Domain Names are a typosquatted version of the trademark SCHNEIDER ELECTRIC. <em>Typosquatting<\/em> is the practice of registering a domain name in an attempt to take advantage of Internet users&rsquo; typographical errors and can evidence that a respondent lacks rights and legitimate interests in the domain name.<\/p>\n<p>Furthermore, the Disputed Domain Name &lt;schrelder-electrlc.com&gt; is inactive. The Complainant contends that the Respondent did not use the Disputed Domain Name, and it confirms that the Respondent has no demonstrable plan to use the Disputed Domain Name.<\/p>\n<p>&nbsp;Finally, the Disputed Domain Name &lt;schreider-electrlc.com&gt; has been used in a phishing scheme. The Complainant asserts that the Respondent uses the Disputed Domain Name to pass itself off as one of the Complainant&rsquo;s employees. Using the Disputed Domain Name in this manner is neither a bona fide offering of goods or services under Policy &para; 4 (c)(i), nor a non-commercial or fair use pursuant to Policy &para; 4(c)(iii).<\/p>\n<p>Thus, the Complainant contends that the Respondent has no rights or legitimate interests in respect of the Disputed Domain Names.<\/p>\n<p>Third element: Bad faith<\/p>\n<p>The Disputed Domain Names are confusingly similar to the trademark SCHNEIDER ELECTRIC. Furthermore, the Dispute Domain Name &lt;schreider-electrlc.com&gt; has been used in a phishing attempt<strong>.<\/strong> On those facts, given the distinctiveness of the Complainant's trademarks and reputation, it is reasonable to infer that the Respondent has registered the Disputed Domain Names with full knowledge of the Complainant's trademarks.<\/p>\n<p>Moreover, the Complainant states the misspelling of the trademark SCHNEIDER ELECTRIC was intentionally designed to be confusingly similar to the Complainant&rsquo;s trademark. Previous UDRP Panels have seen such actions as evidence of bad faith.<\/p>\n<p>Besides, the Disputed Domain Name &lt;schrelder-electrlc.com&gt; is currently inactive. The Complainant contends that the Respondent has not demonstrated any activity in respect of the Disputed Domain Name, and it is not possible to conceive of any plausible actual or contemplated active use of the domain name by the Respondent that would not be illegitimate, such as by being a passing off, an infringement of consumer protection legislation, or an infringement of the Complainant&rsquo;s rights under trademark law.<\/p>\n<p>As prior WIPO UDRP panels have held, the incorporation of a famous mark into a domain name, coupled with an inactive website, may be evidence of bad faith registration and use.<\/p>\n<p>Furthermore, the Disputed Domain Name &lt;schreider-electrlc.com&gt; has been used in a phishing scheme. As such, the Respondent attempted to pass off as one of the Complainant&rsquo;s employees in order to receive undue payment. Therefore, the Complainant states that the Respondent used the Disputed Domain Name in bad faith, as it is well-established that using a domain name for purposes of phishing or other fraudulent activity constitutes solid evidence of bad faith use.<\/p>\n<p>Finally, the Disputed Domain Names have been set up with MX records, which suggests that they may be actively used for email purposes. On these bases, the Complainant concludes that the Respondent has registered and is using the Disputed Domain Names in bad faith.<\/p>\n<p>RESPONDENT<\/p>\n<p>Respondent did not reply to the Complaint.<\/p>",
