    "factual_background": "<p><strong>THE DISPUTED DOMAIN NAME IS IDENTICAL OR CONFUSINGLY SIMILAR TO A TRADEMARK OR SERVICE MARK IN WHICH THE COMPLAINANT HAS RIGHTS<\/strong><\/p>\n<p>The Complainant states that it is one of the leaders in France and Europe in its three core businesses: online brokerage, financial information on the Internet and online banking and it continues its expansion in the range of financial products online.<\/p>\n<p>The Complainant claims that it has nearly 8 million customers in France in the banking sector.<\/p>\n<p>The Complainant's portal www.boursorama.com is the first national financial and economic information site and first French online banking platform.<\/p>\n<p>In addition to the Trademark, the Complainant owns a number of domain names that include \"BOURSOBANK\" such as the domain name &lt;boursobank.com&gt;, registered since November 23, 2005.<\/p>\n<p>The disputed domain name was registered on June 4, 2026 and it resolves to a registrar parking page.<\/p>\n<p>The Complainant states that the disputed domain name is identical to its Trademark.<\/p>\n<p>Furthermore, the Complainant contends that the addition of the suffix &ldquo;.EMAIL&rdquo; does not change the overall impression of the designation as being connected to the Complainant&rsquo;s Trademark.&nbsp;<\/p>\n<p><strong>THE RESPONDENT HAS NO RIGHTS OR LEGITIMATE INTERESTS IN RESPECT OF THE DISPUTED DOMAIN NAME<\/strong><\/p>\n<p><span>The Complainant submits that the Respondent has no rights or legitimate interest in respect of the disputed domain name.<\/span><\/p>\n<p><span>The Complainant asserts that the Respondent is not identified in the Whois database as the disputed domain name. Thus, the Respondent is not known at the disputed domain name.&nbsp;<\/span><\/p>\n<p>The Complainant contends that Respondent is not affiliated with nor authorized by the Complainant in any way. The Complainant does not carry out any activity for, nor has any business with the Respondent.<\/p>\n<p>Neither license nor authorization has been granted to the Respondent to make any use of the Trademark or apply for registration of the disputed domain name.<\/p>\n<p><span>Finally, the disputed domain name resolves to a parking page.<\/span><\/p>\n<p><span>The Complainant contends that the Respondent did not use the disputed domain name or has no demonstrable plan to use the disputed domain name.&nbsp;<\/span><\/p>\n<p><span><strong>THE DISPUTED DOMAIN NAME WAS REGISTERED AND IS BEING USED IN BAD FAITH&nbsp;<\/strong><\/span><\/p>\n<p>The Complainant's submissions on the third UDRP element can be summarized as follows:<\/p>\n<ul>\n<li>The disputed domain name is identical to the Trademark. The Complainant contends that it and its \"BOURSOBANK\" Trademark has a significant reputation in France and abroad in connection with online financial services;<\/li>\n<li>\n<p>The Complainant submits that all the results of a search of the term &ldquo;BOURSOBANK&rdquo; refer to the Complainant.<\/p>\n<p>Consequently, the Complainant asserts that the Respondent must have known about the Complainant and its rights at the time of the registration of the disputed domain name;<\/p>\n<\/li>\n<li><span>The disputed domain name points to a parking page<\/span><span>. The Complainant contends that the Respondent has not demonstrated any activity in respect of the disputed domain name, and it is not possible to conceive of any plausible actual or contemplated active use of the domain name by the Respondent that would not be illegitimate, such as by being a passing off, an infringement of consumer protection legislation, or an infringement of the Complainant&rsquo;s rights under trademark law. The Complainant refers to previous UDRP panels findings that the incorporation of a famous mark into a domain name, coupled with an inactive website, may be evidence of bad faith registration and use and to the doctrine of passive holding.<\/span><\/li>\n<\/ul>",
