Complainant<\/strong> According to the evidence submitted by Complainant, Complainant is a company belonging to the Alibaba Group, a leading Chinese multinational conglomerate. As part of its AI strategy, Alibaba has developed Wan, an open-source family of multimodal video‑generation models designed to produce high‑quality, multilingual video content from text and other inputs. Wan 3.0 is a major upgrade over previous Wan versions: the major improvements have been a much higher video quality, as well as also the chance to do longer videos. According to Complainant, Respondent has no rights or legitimate interest in the disputed domain name. Respondent is neither a licensee nor an authorized distributor of Complainant and has not been granted any permission to use Complainant’s trademarks – nor any variation, misspelling, or derivative thereof – in the disputed domain name or in any other manner. Complainant is not aware of any evidence indicating that Respondent is commonly known by the disputed domain name, or by any name corresponding to it, whether as an individual, business, or other organization. According to Complainant the disputed domain name was registered and is being used in bad faith. In light of Complainant’s registrations and use worldwide, it is reasonable to consider that Respondent could not have been unaware of the existence of Complainant’s trademarks WAN, when registering the disputed domain name. Complainant contends that the requirements of the Policy have been met and that the disputed domain name should be transferred to it.<\/p>\n
Complainant submits that the disputed domain name is confusingly similar to Complainant's WAN trademark. The disputed domain name fully incorporates Complainant’s WAN mark. Complainant submits that in creating the disputed domain name Respondent combined Complainant’s trademark WAN with additional elements, namely the number “3”, which directly correspond to the name of Alibaba’s AI video generation model “Wan 3.0”, and the word “pro”, which stands for the “professional” version of the model. By incorporating this version identifier into the disputed domain name, Respondent reinforces the association with Complainant’s marks and products, thereby making the disputed domain name confusingly similar to the Complainant’s trademark WAN.<\/p>\n
Respondent is not making a bona fide offering of goods or services, nor is it engaged in any legitimate non-commercial or fair use of the disputed domain name. On the contrary, Respondent is using the disputed domain name to promote and offer Complainant’s WAN video generation service, without any authorization. This conduct demonstrates a clear intent to exploit the reputation and goodwill associated with Complainant’s trademark WAN. Moreover, Respondent’s website displayed Complainant’s trademarks, thereby imitating Complainant and misleading internet users into believing that the website was affiliated with or endorsed by Complainant. Such use is not legitimate and further confirms that Respondent is attempting to divert users by capitalizing on Complainant’s brand identity.<\/p>\n
