D’après les informations communiquées, il n’existe aucune procédure judiciaire en cours ou terminée qui concerne le nom de domaine litigieux.
Le Requérant a démontré être le titulaire des marques enregistrées suivantes :
- marque de l’Union européenne INTESA SANPAOLO n° 5301999, du 18 juin 2007 (renouvelée)
- marque de l’Union européenne INTESA n° 12247979, du 5 mars 2014
- marque internationale INTESA SANPAOLO n°920896, du 7 mars 2007 (renouvelée)
- marque internationale INTESA n° 793367, du 4 septembre 2002 (renouvelée)
Le Requérant est également titulaire d’un important portefeuille de noms de domaine, comprenant les marques INTESA et INTESA SANPAOLO dont notamment :
<intesasanpaolo.com>, <intesasanpaolo.org>, <intesasanpaolo.eu>, <intesasanpaolo.info>, <intesasanpaolo.net>, <intesasanpaolo.biz>, <intesa-sanpaolo.com>, <intesa-sanpaolo.org>, <intesa-sanpaolo.eu>, <intesa-sanpaolo.info>, <intesa-sanpaolo.net>, <intesa-sanpaolo.biz>, <clienti-intesasanpaolo.com>, <serviziclienti-intesasanpaolo.com>, <intesasanpaolo-clienti.com>, <cliente-intesasanpaolo.online>, <cliente-intesasanpaolo.com>, <assistenza-intesasanpaolo.com> et <intesa.com>, <intesa.info>, <intesa.biz>, <intesa.org>, <intesa.us>, <intesa.eu>, <intesa.cn>, <intesa.in>, <intesa.co.uk>, <intesa.tel>, <intesa.name>, <intesa.xxx>, <intesa.me>.
Tous ces noms de domaines sont désormais reliés au site officiel http://www.intesasanpaolo.com.
Le Requérant a déposé les documents suivants afin de prouver les faits susmentionnés :
- Informations concernants le Requérant ;
- Copies des marques du Requérant ;
- Extrait de recherche Google sur les mots « INTESA SANPAOLO » ;
- Copie du site internet du nom de domaine litigieux ;
- Deux décisions de l’OMPI pour appuyer leurs arguments ;
- Lettre de mise en demeure adressée au Défendeur.
Le Requérant fait partie du groupe éponyme, qui est l'un des principaux groupes bancaires de la zone euro, et le leader en Italie, avec une capitalisation boursière supérieure à 44,9 milliards d'euros. Le Requérant a une forte présence en Europe centrale et orientale avec un réseau d'environ 900 agences et plus de 7,2 millions de clients.
Le Défendeur a enregistré le nom de domaine litigieux <intesasanpaoloitalia.eu> le 3 septembre 2023. Le nom de domaine est inactif et semble être bloqué par Google Safe Browsing.
Le Requérant affirme que les exigences des Principes directeurs ont été respectées et que le nom de domaine litigieux devrait être transféré á le Requérant.
LE DEFENDEUR N’A PAS REPONDU AUX ARGUMENTS DU REQUERANT.
Le Requérant a démontré, à la satisfaction de la Commission, que le nom de domaine litigieux est identique ou semblable au point de prêter à confusion à une marque de produits ou de services sur laquelle le requérant a des droits (au sens du paragraphe 4(a)(i) des Principes directeurs).
Le Requérant a, à la satisfaction de la Commission, démontré que le Défendeur n'a aucun droit ou intérêt légitime à l'égard du nom de domaine litigieux (au sens du paragraphe 4.a)ii) des Principes directeurs).
Le Requérant a, à la satisfaction de la Commission, démontré que le nom de domaine litigieux a été enregistré et est utilisé de mauvaise foi (au sens du paragraphe 4.a.iii) des Principes directeurs).
La Commission est convaincue que toutes les conditions de procédure prévues par les principes UDRP ont été remplies et qu'il n'y a aucune autre raison pour laquelle il serait inapproprié de rendre une décision.
1. Identité (paragraphe 4(a)(i) des Principes Directeurs)
A la lumière des documents fournis par le Requérant, il apparaît qu'il détient divers droits de marque au moins dans l’Union européenne.
La Commission considère que le nom de domaine litigieux reproduit de manière strictement identique le signe « INTESA SANPAOLO » tel qu’il ressort des documents communiqués par le Requérant.
L’ajout du nom de pays « italia » n’est pas suffisant pour faire disparaitre le risque de confusion entre le nom de domaine litigieux et la marque INTESA SANPAOLO (Voir WIPO Case No. D2012-0047, Compagnie Générale des Etablissements Michelin and Michelin Recherche et Technique S.A. v. Eijiobara Obara).
La Commission considère ainsi que le nom de domaine <intesasanpaoloitalia.net> est similaire au point prêter à confusion avec les marques enregistrées du Requérant.
2. Le Défendeur n’a aucun droit ni intérêt légitime concernant le nom de domaine (paragraphe 4(a)(ii) des Principes Directeurs).
Le Requérant affirme que le Défendeur n'a jamais obtenu de licence ou d'autorisation pour enregistrer le nom de domaine <intesasanpaoloitalia.net>. En outre, le Défendeur n'a jamais cherché à obtenir le consentement du Requérant pour enregistrer le nom de domaine susmentionné. Le Défendeur n’est pas identifié dans la base de données Whois sous la dénomination « INTESA SANPAOLO ».
Par ailleurs, le nom de domaine est inactif et bloqué. Par conséquent, il n'existe aucune preuve de l'utilisation ou de la préparation de l'utilisation du nom de domaine litigieux dans le cadre d'une offre de bonne foi de produits ou de services, ni d'une utilisation légitime non commerciale ou loyale du nom de domaine, sans intention de gain commercial de détourner de manière trompeuse les consommateurs ou de ternir la marque de produits ou de services en cause (Voir, WIPO Case n° D2011-0421, Cleveland Browns Football Company LLC v. Andrea Denise Dinoia).
Enfin, le Défendeur a eu l'occasion de présenter ses arguments à l'appui de ses droits ou intérêts légitimes sur le nom de domaine litigieux. Toutefois, l’absence de réponse démontre le manque d’intérêt légitime du Défendeur dans l’enregistrement et l’utilisation du nom de domaine litigieux.
En conséquence, la Commission considère que le Défendeur est dépourvu de tout droit ou intérêt légitime à utiliser le nom de domaine litigieux.
3. Le nom de domaine a été enregistré et est utilisé de mauvaise foi (paragraphe 4(a)(iii) des Principes Directeurs)
Ainsi, compte tenu du caractère distinctif de la marque et de sa renommée, la Commission estime que le Défendeur a enregistré le nom de domaine litigieux en pleine connaissance des droits de marque INTESA SANPAOLO.
Par ailleurs, le Requérant a bien démontré que le nom de domaine litigieux reproduit intégralement la marque INTESA SANPAOLO. La Commission considère donc que le Défendeur ne peut pas raisonnablement prétendre qu'il avait l'intention de développer une activité légitime avec le nom de domaine litigieux.
Enfin, le nom de domaine litigieux redirige vers une page inactive bloquée par Google Safe Browsing, ce qui suggère une activité de mauvaise foi, tel de l’hameçonnage.
La Commission considère qu’un tel enregistrement et usage du nom de domaine litigieux est entaché de mauvaise foi.
